Dear President,

My attention has recently been drawn to the 150 day prison sentence of the Mapuche leader Lonko Juana Calfunao Paillalef, her husband Antonio Cadin and their children Jorge and Waikilaf; as well as her sister Luisa Calfunao, mother of three young children, one of which is 3 years old. Lonko Calfunao's younger sister is only 7 and, faced with the arrest of practically her whole family, finds herself helpless. I am alarmed that the Chilean justice system is passing such severe sentences for minor offences such as “public disorder”.

I would like to express my concern about the health of the prisoners, both physical and psychological. In particular that of Luisa Calfunao who has suffered from hysteria after enduring persecution, detention, beatings and humiliation from the police, as well as attacks on her community, Juan Paillalef . As a result of this, she has had to be moved from prison to the psychiatric ward at the Temuco Regional Hospital.

I consider the struggle of Lonko Juana Calfunao and her family to be a just one, in respect of the rights of their community, and I deplore the denial of their right to peaceful protest. Since the start of the protests, against the seizure of land during the Chilean invasion of Mapuche territory, the charge of “public disorder” has been regularly used as a pretext to keep Lonko imprisoned.

I would like to state on record that the way in which Lonko and her sister have been, and are being, treated by state police officers representing their government is unacceptable in a democratic country governed by the rule of law.

Some of the events referred to are:

In May 2000, Lonko Calfunao was subjected to torture by police officers from Temuco 's 2 nd police station, which caused her to have an abortion.

On 23 December 2005, Lonko Calfunao and her sister Luisa were brutally beaten by police in their house, in front of their own children and other children from the community.

On 4 January 2006, police raided the community once more and arrested the Calfunao sisters, holding them in custody in Padre Las Casas' 3 rd police station, w here they were subjected to beatings and humiliation.

I regard, without doubt, these events as clear evidence of the political persecution of Mapuche leaders who are fighting for freedom and justice for their people. Despite the political nature of the Mapuche leaders' struggle, Chilean justice imprisons them alongside common offenders.

I therefore ask of you to take the following measures as soon as possible:

Guarantee recognition of the political status of Lonko Calfunao's struggle and ensure a fair trial for her in a competent, independent and impartial court;
With respect to the principle of proportionality of punishment: the disproportionate punishments that are being given to these people are not appropriate in a country governed by the rule of law;

Investigation and sanction, through legal processes, of the state police officers responsible for the physical abuse and persecution of community members, as well as the unlawful arrest of Lonko and/or members of her family/community;

Recognition and respect for the Mapuche people, their communities, and particularly their land. Negotiation with communities and compensation in accordance with international regulations for land acquired. In cases where land has been acquired without respecting international regulations, compensation should be given or the land returned to the Mapuche people.

La comunidad Juan paillalef, sector curaco, camino a cólico, informa a los organismos internacionales lo siguiente:



1) El día 21 de diciembre a las 8:30 horas a.m. se llevara a efecto una audiencia para debatir las peticiones efectuada por los imputados mapuches de la comunidad Juan paillalef



2) También se le elegirá el abogado defensor público Sr. Ricardo Cáceres, a que exija al tribunal la modificación de las medidas cautelares que pasan en contra de los comuneros, y que se encuentra privado la libertad desde el 16 de nov del 2006 estos son :

3) Pedimos a las organizaciones internacionales a hacerse presente en esta audiencia para, garantizar un debido proceso, y la libertad de los comuneros, el encarcelamiento de Juana Calfunao, Antonio Cadin que se ve obstaculizado por el desarrollo familiar (Construcción de 14 viviendas en la comunidad desde las fechas de noviembre a marzo del 2007 como plazo debido al vencimiento de los subsidios por la situación climática de la región).

No puedo evitar sentir un profundo dolor e indignación, al conocer los terribles y violentos tratos que han debido soportar los miembros de la familia Calfunao, pertenecientes a la Comunidad Mapuche Juan Paillalef, por parte de las fuerzas de seguridad (gendarmería, policía).

Me refiero específicamente a Manuel Cadin Calfunao y a Doña Juan Calfunao Paillalef, quienes junto con otros miembros de su familia (Antonio Cadin Huentelao, Ernesto Lincopan, Jorge Landero Calfunao y Luisa Ana Calfunao Paillalef) han sido injustamente encarcelados. En estos momentos se necesita garantizar la seguridad y la integridad física y psicológica del señor Manuel Cadin Calfunao, y ordenar su libertad inmediata en caso de encontrarse detenido en ausencia de cargos legales válidos, o, si estos cargos existen llevarlos ante un tribunal independiente, competente, justo e imparcial, respetando todos sus derechos al debido proceso en todo momento.

Es fundamental también, Sra. Presidenta, llevar a cabo una investigación exhaustiva, independiente e imparcial por parte de instancias civiles , en torno a los hechos que arriba mencionamos, con el fin de identificar a los responsables, llevarlos ante un tribunal independiente, justo e imparcial y aplicarles las sanciones penales y/o administrativas prevists por la ley.

Es para mi y para todos los que venimos trabajando en estos temas, garantizar en todas las circunstancias el respeto por los Derechos Humanos y las libertades fundamentales de conformidad con las leyes internacionales sobre Derechos Humanos, en particular con las disposiciones de la Convención Americana de Derechos Humanos, el Pacto Internacional de Derechos Civiles y Políticos y la Convención contra la Tortura; instrumentos todos, ratificados por la República de Chile.

Esperamos, Sra. Bachelet, pueda usted utilizar toda su sabiduría y sentido de justicia, para finalizar con los maltratos e injustos encierros de integrantes del Pueblo Mapuche, que sólo tienen la culpa de defender el derecho a sus tierras, donde viven desde siempre, y a sus recursos naturales, actualmente en peligro debido al avance de empresas latifundistas.

CHANGE THE WORLD DANCING!

We Invite you to participate in this experimental stage of the workshop "Change the world dancing" . This project solidarises with the Juan Paillalef Community, as they fight for their human and land rights.(www.mapundial.org)

There are no fix prices, as this project is organized by
Mapundial and supported by volunteers that wish toshare their knowledge of dance and support the Juan Paillalef Mapuche community.

This project works on donation and a barter system:

Money donations: As much as you can or wish to contribute per class.

Barter System: Runs according to the nessecities of the community needes, ie- Computers, clothe, tools, ect.)

Exchange: Students can also exchange workshops for volunteer work (1 to 2 hour p/w) this may be handing out information, supporting actions, organising benefit parties, concerts and/or performances. (your input will be apreciated.)

Using art as a means to help human rights abuses, we can also offer a physical space for your project in the upcoming Mapundial (www.mapundial.org) activities, or activities organised by Stichting Patchamama (www.patchamama.org)

Mapundial is an ONG founded to spread the knowledge and culture of the Mapuche-indians and to realise projects in Chili in collaboration with Mapuche-organisations and communities to improve their rights.

The Mapuche are the original habitants of the territory today known as Chile.The Mapuche are not constitutionally recognised as a people. As a reaction to this situation, various mapuche-communities have united themselves
in a network to defend the human rights of the indigenous people.
